Entity: Montres Global Ltda. – "MON 3"

Introduction

These Terms and Conditions govern the use of the software, systems, and services provided by MON 3, including the use of APIs and partner services.

MON 3 operates through a partnership model with companies ("third-party partners" or "partners") that integrate our services into their platforms to provide stablecoin services to their clients/users ("users"). To facilitate money movement and compliance functions, we work with licensed third-party partners from financial institutions and service providers ("Payment Providers").

Nature of Services

MON 3 is a technology service provider (software provider/technical intermediary), and not a virtual asset service provider. These Terms apply to Partners and Clients and define our relationship with the Payment Providers that use or support MON 3 services.

We are merely a technology provider that operates a connectivity platform with licensed infrastructure and a third-party cross-border payments API. We do not provide virtual asset services; we act exclusively as technology intermediaries and system integrators. The regulated activity is performed by a licensed partner institution, responsible for custody, settlement, and asset transfer.

All identity verification (KYC/KYB), transaction monitoring, and sanctions/AML/CFT screening is conducted by our licensed partners, in compliance with applicable regulatory obligations. MON 3 technically integrates this infrastructure and applies the restrictions and blocks required by these partners.

By accessing or using MON 3 services, you agree to be bound by these Terms and those of our third-party partner. If you are accessing MON 3 services on behalf of a company (business user), these Terms apply to you and the company.

Our Privacy Policy explains how we collect and use the personal data you share with us. Each time you visit our website, create an account with us, or use MON 3 services, you agree to the collection, use, and disclosure of your personal data as described in our Privacy Policy. Your consent is valid as long as you use MON 3 services.

Eligibility and Account Security

Partner Relationship

MON 3 offers its services through third-party partners that integrate MON 3 services with their own platforms. To open a MON 3 Account (platform access), you accept and agree to the Terms and Conditions and the Usage and Privacy Policies of our partners.

Eligibility Requirements

To use a MON 3 account, you must:

  • Be at least 18 years of age; and
  • Have the legal capacity to accept these Terms.

If you are opening a MON 3 account for a business, you warrant that you are authorized to do so and that you will use the services for commercial purposes only.

Restricted Locations

We cannot provide a MON 3 account if you are in a location where we do not offer our services ("Restricted Locations"). We may change the list of Restricted Locations at any time without prior notice.

Identity Verification

We request personal data to verify your identity and process your registration. Our Partner may share this data with us with your permission, or we may collect it directly from you. This data includes name, address, date of birth, and other information as needed. A complete list of the data we collect and how we use it is available in our Privacy Policy. Your data must always be accurate and up to date.

Information Sharing

Consent to Information Sharing

You consent to all information provided by you or collected about you being shared:

  • with MON 3 third-party partners, who are payment providers (custody institutions and global stablecoin transfer services) with which MON 3 infrastructure is integrated;
  • with regulatory authorities; and
  • as required for compliance and money movement purposes.

Use of the Licensed Partner Institution API

MON 3 uses the Licensed Partner Institution API to perform actions and infrastructure execution. Clients acknowledge that, by accepting and agreeing to these MON 3 Terms, they also accept and agree to the terms and conditions of MON 3's third-party partners.

Chain Control

Chain Disclaimer

MON 3 does not operate, own, or control any chain. Chains may change their operational rules without prior notice, and third parties may create copies ("Forks"), resulting in multiple versions of a chain.

Business Model

MON 3 is a technology service provider (software provider/technical intermediary), and not a virtual asset service provider.

Fork Policy

MON 3 does not support any type of stablecoin or digital asset from any forked chain.

Chain Risks

MON 3 is not responsible for chains, and the user assumes all risks when buying or selling stablecoins. We do not guarantee the functionality or security of chains.

Risk Acknowledgment

There are many risks associated with buying and selling stablecoins, including but not limited to market volatility, regulatory changes, and technical vulnerabilities. By using MON 3 services, you acknowledge that you understand and accept these risks.

Nature and Limitations of Services

MON 3 is a global technology platform that enables its users to interact with regulated financial infrastructure through a seamless digital experience. MON 3 itself is not a financial institution and does not hold custody of any fiat or crypto funds.

MON 3 is a technology service provider (software provider/technical intermediary), and not a virtual asset service provider. All financial operations, including card issuance, identity verification, PIX and ACH payments, and transactions, are performed by licensed third-party providers (Licensed Partner Institution).

Users interact with these services through the MON 3 platform, which orchestrates the user experience, identity flow, and transaction initiation. MON 3 does not guarantee the continuous availability or service performance of any third-party infrastructure.

Infrastructure Providers and Their Responsibilities

MON 3 relies on the following providers to deliver services to users (each provider operates under its own licenses and compliance obligations):

Card Issuer

Licensed provider responsible for card issuance and processing of transactions associated with the MON 3 card.

Local Payment Providers

Integrations with local financial institutions for PIX, ACH, and other payment networks, subject to availability by jurisdiction.

Partner Compliance

All licensed partners follow rigorous KYC/KYB processes, continuous transaction monitoring, and sanctions screening. These requirements are applied to all MON 3 users.

MON 3 complies with the policies and procedures defined by its partners, ensuring technical and operational integration with these controls.

Limitation of Liability

MON 3 acts as a technology provider and is not responsible for any failures, unavailability, or losses arising from services provided by licensed partners or by chains.

Under no circumstances shall MON 3 be liable for lost profits, loss of revenue, data, or indirect damages arising from the use of the services.

Partner Privacy Policy

By using MON 3 services, you are also subject to the privacy policies and terms of the licensed partners. We recommend a detailed reading of the applicable documents.

Please refer to the privacy policies of the partners responsible for custody and processing in their respective jurisdictions.
